These Terms govern the use of the Padelatic service ("Service"), provided by [Entidade legal a constituir], tax no. [NIF], with registered office at [Morada da sede] ("we"). By creating an account you accept these Terms, the Privacy Policy and the Data Processing Agreement.
1. Purpose
The Service is a padel-coaching management platform for coaches: players, sessions, drills, evaluations, calendar and share pages. It is a subscription (SaaS) service.
2. Account and eligibility
You must be at least 18 years old and provide truthful information. You are responsible for keeping your credentials confidential and for all activity on your account.
3. Subscriptions, pricing and billing
- The current plans and limits are on the pricing page. Prices are shown plus VAT where applicable; tax is calculated at checkout based on the customer's country and tax status (an EU business with a valid VAT number → reverse charge).
- Payment is processed by Stripe. The subscription renews automatically at the end of each period (monthly or annual) until cancelled.
- Trial period: 14 free days. Once the period ends without an active subscription, access is suspended.
- Cancellation: you may cancel at any time; access continues until the end of the period already paid. Save where required by law, there is no refund for periods already elapsed.
- Right of withdrawal (consumers): under the applicable rules for digital services a 14-day period may apply; by starting to use the Service during that period the consumer may lose the right of withdrawal as to the part already performed.
- We may change prices with reasonable prior notice; changes do not affect a period already paid.
4. Acceptable use
You may not: use the Service for unlawful purposes; upload data you have no lawful basis to process; attempt to access other users' data; reverse-engineer, resell or overload the Service; introduce malicious code.
5. Your data and your players' data
- You retain ownership of the content you enter.
- For player data, you are the Controller and we are the Processor, under the DPA. You warrant that you have a lawful basis to process that data, including the parental consent for minors, and that you have informed the data subjects.
- You grant us a limited licence to process that content solely to provide the Service.
6. Availability
We strive to keep the Service available, but it is provided "as is", without warranty of uninterrupted availability. We may carry out maintenance and updates.
7. Limitation of liability
To the maximum extent permitted by law, our total liability to you is limited to the amount paid in the 12 months preceding the event. We are not liable for indirect damages, lost profits or loss of data not attributable to our intent or gross negligence. We recommend you keep copies of data you consider critical (see export in the Service).
8. Suspension and termination
We may suspend or terminate the account for breach of these Terms or non-payment. You may close the account at any time in account settings; after closure, data is handled per the Privacy Policy.
9. Changes to the Terms
We may update these Terms; material changes will be communicated and you may be asked to accept again. Continued use after they take effect constitutes acceptance.
10. Governing law and jurisdiction
These Terms are governed by Portuguese law. For consumer disputes, the consumer may resort to alternative dispute resolution bodies and the European ODR platform. Jurisdiction: [comarca competente].
